These terms and conditions shall govern and manage your use and access to our website, www.droomme.com, including the services and features that we provide, viewing content and communicating within the Droom community in the website.

These terms will be applied fully and affect your use of this website. By creating an account and using this website, our services, and features, you agreed to accept all terms and conditions written here. Droom Service

Droom agrees to provide its users with the services in the website that include all of the features, services, products, information, communication, and software that bring the users closer to one another within the Droom community. The said service includes the following aspects:

 

Droom subscription

Droom provides two kinds of subscriptions plans:

• One month subscription in which the subscriber will receive one box with 4 to 6 products 
• Three month subscription in which the subscriber will receive 3 boxes (one per month) with 4 to 6 products (subscribers can choose 4 out of 6 products and enjoy special discounts and offers)

 

Restrictions

You need to commit to a few restrictions in order to be a part of the Droom subscriber list and they are as follows:

• Selling and/or sublicensing.
• Use of the website without updating the user profile.
• Using the website in any way that is or may be damaging to the website.
• Using the website in any way that impacts user access to the website.
• Using the website contrary to applicable laws and regulations, or in any way may cause harm to the website, or to any person or business entity.
• Engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this website.
• Using the website to engage in any advertising or marketing.
• Posting reviews of other products or services that were not included in your box.
• Attempting to buy or sell any kind of products or services through your account.
• Posting anything considered inappropriate to the community.
• Impersonate others or provide inaccurate information.
• Engaging, helping or encouraging in any misleading, unlawful, illegal or fraudulent activities.
• Posting private or confidential information or doing anything that violates someone else’s rights including intellectual properties.

Certain features of this website are restricted from being accessed by the guest users. Any username, e-mail, and password you may have for this website are confidential and you must maintain confidentiality as well.

 

Commitments and Permissions

1.   Registration and passwords.

• You may access the Droom website as guests and to take advantage of our website, services, and features you will need to purchase one of the subscription plans.
• You must provide accurate and up to date information in order to create an account with Droom.
• You agree to not disclose your password to any user, you will be fully responsible for all acts of any user who accesses your account using your password.
• You may elect to change the password at any time using the facility provided on the website, you must immediately notify us of any password which is lost or used in an unauthorised manner.

2.   Permissions you give to Droom

You give us permission as a part of our agreement so that we can provide users with the Droom website, our services, products, and features.

• In these Terms and Conditions, “Your Content” shall mean any audio, video text, images or other material you choose to display on this website. By displaying your content, you grant Droom a non-exclusive, worldwide irrevocable, sub-licensable licence to use, reproduce, adapt, publish, translate and distribute it in any and all media.
• You give Droom permission to show your username, profile picture, and information about your likes, shares, comments, followings, and followers in order to allow us to conduct our business functions, to meet any regulatory requirements which apply to our business, to market and sell out products and services and to conduct employee activities. 3.   Objectionable/Questionable content.

Droom has no tolerance for objectionable/questionable content or abusive users. In any case, where objectionable/questionable content or abusive users are found throughout the Droom website, users have the right to:

• Flag offensive content/users.
• Report offensive content/users.
• Block abusive users.

Droom will review the said reports/flags and act on the reports within 24 hours by removing the reported/flagged content and terminate/disable the user who provided the offending content.

 

Terminating/Disabling accounts

If we believe that any content or information you share on this website violates these Terms of Use, Droom Privacy Policy or by the law, we may remove the said content or information. We can refuse to provide and stop providing all parts of the services and features we offer, including terminating or disabling your Droom account; to protect the Droom community. You will be notified when appropriate before we terminate or disable your account.

 

Subscription Cancelation

You can cancel your subscription within the first two months of your subscription.

 

Content Removal

Deleted content may stay for a certain period of time in the backup copies of our system but it will not be visible to other users.

 

Disputes

• We don’t have any control over what users do or say and we also aren’t responsible for your and their actions, content, unlawful or inappropriate conduct, online or offline.
• Our responsibility is limited as much as the law will permit for anything that happens on the website. We shall not be responsible for any lost profits, revenues, information or data. This includes when we delete your content, information or account.

 

How will Droom handle disputes?

The laws of the country that the consumer resides in will be applied to any claims made, cause of action or dispute they (consumer) have against us that arises out of or relates to these terms and they may resolve their claim in any court in that country. You also agree that the claim must be resolved exclusively in the Kuwait Court; that you submit to the personal jurisdiction of the court and that the laws of Kuwait will govern these terms and any claim without regard to conflict of law provisions.

 

Assignment

Droom is allowed to assign, transfer, and subcontract its rights and/or obligations under these terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these terms.

 

Updates and Changes to these Terms

We may from time to time review and update these terms. Unless otherwise required by the law, we will notify you about changes and updates done including taking into account new regulations and technology and give you the opportunity to review the revised Terms before you choose to continue using the Droom website.

 

Marketplace Terms and Conditions

These terms will be applied fully and affect your use of this market place. by purchasing products and services, you agreed to accept all terms and conditions written in here. you must not use this market place if you disagree with any of these terms and conditions.

 

Droom Marketplace Terms

• by agreeing to these terms and conditions, you represent that you’re at least the age of maturity in your residing country.
• you may not use any of our products for any illegal or unauthorised purpose nor will you in the use of the service violate any laws in your jurisdiction.
• a breach or violation of any of the terms will result in immediate termination of your service.

 

General Conditions

• droom reserves the right to refuse service to anyone for any reason at any time.
• you agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the service, use of service, or access to the service or any contact on the market place through which the service is provided, without written permission from us, droom.

 

Data Protection, Privacy & Security

droom requires processing the information about you in order to provide you with the service and are reasonably necessary for one or more of our functions or activities. droom has access to your personal information that you provide to droom such as name, address, contact information.

 

Delivery Terms

• We charge 2 KD for all local deliveries, other GCC we charge 6 KD.
• Local deliveries take 1 to 2 business days, other GCC deliveries take 3-4 days.

 

Payment Terms

Full payment needs to be made by the customer, after which orders will be dispatched. Payments can be done online through knet, visa, mastercard. You are responsible for paying any governmental taxes imposed in connection with use of the website or the purchase or any products, including sales, use or excise taxes. To the extent that we are obligated to collect such taxes, the applicable tax will be added to your payment. 

 

Billing Information

Accuracy of billing information and account information is mandatory as we, droom reserve a right to refuse any order you place with us in our marketplace. In the event that we make a change to or cancel an order, we will notify the customer/user by contacting the e-mail and/or billing address/phone number provided to droom by the customer/user. We also reserve the right to limit or prohibit orders that appear to be placed by dealers, resellers or distributors. 

 

You agree to provide droom with current, complete and correct account information for all purchases made through our marketplace. you agree to update your account and other information, including your email, credit card numbers and expiration dates, so that droom can complete your transaction and contact you if needed. 

Return, Cancellation, Exchange and Refund Policies

An order placed by a customer can only be cancelled before the order status is out for delivery and a refund will only be processed if the order has been cancelled within the said time. 

No exchanges will be offered for food and cosmetic products.

If the product is damaged during the process of delivery, we will offer a replacement. you must send an email at hello@droomgtc.com along with the picture and receipt of purchase as proof within 1 day of delivery with the subject damaged product.

 

Product Information

Droom attempts to be as accurate as possible. However, droom does not warrant that product descriptions and content is accurate, free of errors, complete or current. We reserve the right to correct any errors and inaccuracy and to change or update information. We undertake no obligation to update, amend or clarify information in the service. 

 

Dispute Clause

Our responsibility is limited as much as the law will permit for anything that happens on the website. we shall not be responsible for any lost profits, revenues, information or data. This includes when we delete your content, information or account. The laws of the country that the consumer resides in will be applied to any claims made, cause of action or dispute they (consumer) have against us that arises out of or relates to these terms and they may resolve their claim in any court in that country.
